DIVISON 7A CONSTITUTIONS

CCASA Div 7A constitutions (with trust election notes and minutes) are fully guaranteed and insured by our lawyers which gives you even more protection. This protection is provided to you FREE. Every professional adviser should now be aware of Division 7A of the Tax Acts. Clients can now insulate their companies from this Division by simply having one of our new constitutions (or constitution conversions). Division 7A (a Division of the Tax Act that treats certain payments, loans and forgiveness’s by a company to a shareholder or an associate of a shareholder, as assessable dividends) and Division 974 (that treats certain payments/loans/advances by a shareholder or an associate of a shareholder to the Company as equity interests rather than debt interests) have to be provided for in your loan facility documentation.

Recent changes to (section 109UB of Division 7A being sections 109XA, XB and XC) concerning distributions to associates of corporate beneficiaries of trusts have also been addressed in our new constitutions and trust documentation.
